To be eligible to be a Republican Elector, a person must be a qualified voter of Texas and affiliated with the Republican Party (Texas Election Code section 192.002).  A qualified voter means a person who: (1) is 18 years of age or older; (2) is a United States citizen; (3) has not been determined incompetent by a final judgment of a court; (4) has not been convicted of a felony, unless he has fully completed the sentence, including incarceration, parole, and probation or has been pardoned; (5) is a resident of the state; and (6) is registered to vote (section 11.002).  A person may become affiliated with a party by either voting in the party’s primary or taking an oath of affiliation (sections 162.003 – 162.008).

In addition to Texas law, the US Constitution has the following provision regarding Presidential Electors:

Article II, section 1, clause 2:  no Senator or Representative, or Person holding an Office of Trust or Profit under the United States, shall be appointed an Elector.

That phrase “holding an office of trust or profit” is subject to interpretation and has not been tested in court.  The RNC Office of Legal Counsel has adopted a very conservative interpretation and believes individuals who fall into one of the groups below would either be disqualified from being an Elector or would be subject to legal challenge:

  • Federal Elected Officeholders
  • Federal Employees
  • Federal Government Contractors
  • Active Duty Military
  • U. S. Military Reserves
  • National Guard
  • Federal Board or Federal Commission members (paid or volunteer position)

I hereby pledge to vote for the Republican Party’s nominees for President and Vice-President at the meeting of Presidential Electors held on December 17, 2012 in Austin, Texas.
